74. MAINTENANCE.
Islam does not endorse the monthly payment of maintenance. It is not for inflicting injustice upon women. Instead,
Islam rejects such a system only to benefit women and also to find out better arrangements than this kind of maintenance.
For secur4ing a 'monthly maintenance' half or that amount is spent for the court expenses. This burden lies on the women.
Besides, most of the husbands who are liable to pay maintenance elude from the burden by giving forged accounts (i-e. as if they are very poor and unable to give maintenance) or they deceive the divorced wife by giving very meager amounts.
Moreover if maintenance was regularly obtained by a divorced woman, then she would not remarry since she could not get maintenance if she got remarried.
This (monthly maintenance) also might incite certain divorced women to choose vices…
So instead of endorsing this procedure of 'monthly maintenance' which has many short comings as we have said above, Islam has established two kinds of protection for divorced women.
The first protection is that a woman should secure a considerable amount as Mahar during wedding and keep it under her custody (because that would help her as maintenance if she was divorced)
The second protection is that either Islamic government or Jamaat should secure a huge amount or a property from the husband and distribute it to the divorced women. The Quranic verse 2:241 also reveals this only. Every word of this verse must be deeply regarded.
Never the less, most of the Muslims assume that Quranic verse 2:241 specifies the maintenance which was given during Iddah.
Allah could have simply said during Iddah if their assumption was correct. But instead of saying like that Allah says 'by fair means' and 'by just means'.
It would not be 'fair means' or 'just means' to provide maintenance to a woman for three month only. Having lived with her and enjoyed her youth in the prime of life. If it had happened women members of their own family, what will be the state? They should think from the angle of a person who was affected.
What the Quranic verse, 2:236, says should be taken as the yard - stick for this. The idea of this verse should have been only that the maintenance amount could be given by the affluent according to their capacity and by the poor according to their capacity.
It is obligatory for the jamath to make the affluent pay millions to the divorced person.
But if the divorced person could five only a few thousands of rupees, they should collect the same and handover it to the divorced woman. It is an inevitable obligation (compulsory) for those who fear God.
Usually the Jamaats get back the dowry from the husband (which was given to him at the time of wedding) and handover the same to the divorced woman. Actually the dowry is meant for her only. So they (the jamaaths) do not get anything from the husband (except dowry) as compensation for divorce.
The Muslims people face several criticisms only because they have failed to implement this command of Allah. This negligence is being utilized for the anti Muslim propaganda, Moreover the non Muslims also try to impose a upon Muslims pseudo maintenance.
Hence the Jammaath should deeply regard every word of this verse and render justice to women.
In the Quranic verse 65:6, it has been said that if the divorced woman was pregnant she should be maintained till she begot a child. But we should not assume that maintenance should be given during 'Iddah' only.
That verse (65:6) only specifies the additional expenditure that a husband would bear since his wife (divorced woman) was carrying his 'fetus'.
But the commands made in verse (2:241) cannot be disregarded under the pretext of the verse (65:6)
